Readers are cautioned that I delete what I judge to be extraneous text, and often paraphrase in order to make the legalese a lot more readable; also that comments added are a mix of my own opinions, best guesses, snarking, and judgements, and therefore may not be entirely accurate. Such deletions may accidentally result in a key omission; if you wish to read the original text, please follow the link in the sidebar to the posted agenda.
Please note that I’ve gone back and added some notes and links to last week’s agenda where I have more information. I will try to keep this practice up.
Public Comment, 6/20, 2-5 pm: Citizens desiring to address the council must register in advance with the City Secretary. (One day in advance, not one week as I said before).

MAYOR’S REPORT — no subject listed.
Consideration of regular matters will commence at approximately 10:15 A. M.

1. Announcement by City Controller, and motion to adopt the results of the electronic auction-style bidding for the sale of $140,000,000.00 Tax and Revenue Anticipation Notes, Series 2006, based on the lowest true interest cost
Uh, wait, these aren’t construction bonds or the like… “Tax and Revenue Anticipation sounds like debt financing… if these are related to this story (not a given, by any means), where did the 40% jump come from?

5. REQUEST from Mayor for confirmation of the appointments to the GREATER GREENSPOINT MANAGEMENT DISTRICT OF HARRIS COUNTY BOARD OF DIRECTORS, for terms to expire June 1, 2009:
· Position Five – MR. RAY BEJARANO
· Position Six – MS. GLORIA A. CARR
· Position Nine – MR. JOHN R. BELTZ, JR.
Yet another TIRZ. Remember, the board submits who it wants, and all the council can do is say yes or no; thus membership in the board of these powerful taxing districts is essentially closed, and the businesses being taxed have no say in the governing of the district.
6. RECOMMENDATION from Chief of Police for approval of Law Enforcement Agreement between HARRIS COUNTY and CYPRESS CREEK HOSPITAL for law enforcement services of two (2) deputies from Harris County Constable Precinct 1
Huh? HC Constable’s office… maybe it’s because the hospital is inside city limits and this gives them police authority where they wouldn’t normally have it?
DAMAGES: Item 7.
7. RECOMMENDATION from City Attorney for settlement of claim of PAUL A. LOCKE – $85,000.00 – Property and Casualty Fund.. Ok, who backed a dump truck into this guy’s Lexus? (jk, I have no idea what damages this is. Maybe I can check it later.)

Items 11 and 12: Property
11. Summary: Another eminent domain proceeding for bike trails. This time we’re paying off the Union Pacific Railroad Company, for acquisition of Parcel AY2-172C; for the COLUMBIA TAP HIKE AND BIKE TRAIL PROJECT (Polk St. – Dixie Dr.); CIP/GFS N-0420-22-1 – $354,567.00. A third of a million dollars for another little-used bike trail. There’s 20% of a cadet class at HPD…. Or more overtime for officers to sit in court.
12. Condemnation of the Parcel HY5-001, located at 5603 Van Fleet Street, owned by Thuong Thi Tran, for the FIRE STATION NO. 35 EXPANSION PROJECT, CIP C-0142-01-1. Hi, too bad you didn’t like our underbid on the price, so we’re just going to take it now. Arbitrate us, baby.
Items 13 and 14 : “Purchasing and tabulation of bids
13. C. F. MCDONALD ELECTRIC, INC for Tennis Court Lighting Services for Building Services Department – $66,869.00 and contingencies for a total amount not to exceed $70,212.45. Tennis courts somewhere in Alvarado’s district get some new lights.

Sounds like we’re buying garbage trucks? That was a mouthful. Just how many governments are involved in that and what is the HGACSWMD?
Items 15 through 51: Ordinances.
15. ORDINANCE amending City of Houston, Texas, Ordinance No. 2006-503 relating to Permit and Inspection Fees in the City of Houston Building Code. Without the backup, I can’t tell for sure, but I’d bet they’re going up. A lot of city fees haven’t been looked at in 20-30 years, much like that $100 rent.
16. ORDINANCE AMENDING CHAPTER 15 OF THE CODE OF ORDINANCES, HOUSTON, TEXAS, relating to the Minority And Women Business Enterprises Program by adding Small Business Enterprises as a qualifying classification to such program. So does this mean that now all any large company has to do is have one of its project supervisors form his own company as a front? I’d like to know what actual minority contractors think of this. It’s one of those “follow the money things.
17. ORDINANCE amending Exhibit “A of City of Houston Ordinance No. 2006-130 by adding Twenty (20) Fire Fighter Positions, Sixteen (16) Engineer/Operator Positions and Four (4) Captain Positions. Make it so, Number One. And add some police while you’re at it?

21. ORDINANCE consenting to the creation of HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO. 450
Lest you think we want to provide city services to city residents, the last two are inside the city.
22. ORDINANCE establishing the north and south sides of the 1600 block of Banks Street within the City of Houston as a special minimum lot size requirement area pursuant to Chapter 42 of the Code of Ordinances, Houston, Texas –

26. ORDINANCE establishing the south side of the 2300 block of Watts Street within the City of Houston as a special minimum lot size requirement area pursuant to Chapter 42 of the Code of Ordinances, Houston, Texas –
Most of these are in Clutterbuck’s district.

Hobby Airport, CIP A-0528-06.1; approving a purchase and sale agreement with the owner of the land (Frank W. Harley) – Harley , David’s son. And it was good.
29. ORDINANCE appropriating $93,648.36 out of Water & Sewer System Consolidated Construction Fund for Reconstruction of Aldine-Westfield Road, Segment B, from Simmans Road to Hydro 55 Street, GFS S-0521-24-3 & R-0521-24-3 (SB9105)
30. ORDINANCE appropriating $10,240.00 out of Water & Sewer System Consolidated Construction Fund and $80,275.20 out of Street & Bridge Consolidated Construction Fund for Reconstruction of Industrial Road from Federal Road to Sheffield Boulevard, GFS S-0521-S5-3 & N-0715-01-3 (WA10854 and SB9277) – I can personally attest that this is a patch on what is needed, unless the County is ponying up the rest through an agreement we have with them on this project. That road is a hazard to drive down; entire slabs of concrete have buckled and settled under the weight of the trucks coming from the port. The foundations of the road must have been done to residential standards, to account for it; the one time I rode down that street, I thought the S10 we were in would lose its suspension.
31. ORDINANCE appropriating $20,037.50 out of Water & Sewer System Consolidated Construction Fund and approving and authorizing Developer Participation Contract between the City of Houston and HERITAGE HOME BUILDERS, L.P. for Construction of Sanitary Sewer Lines to serve the development located on Welch Street, CIP R-0802-39-3.

Normally I’m simplifying these agenda items as I go through to reduce the legalese and make them more to the point. But on this one I had to look at and go “Whaaaaaaaaa?â€? WTF is this for? Definitely need to look at the backup on this one….
33. ORDINANCE appropriating $6,848,281.00 out of Public Library Consolidated Construction Fund to 3D/INTERNATIONAL, INC for Construction of Jesse H. Jones Central Library Renovation, GFS E-0011-01-3.
34. ORDINANCE appropriating $1,709,400.00 out of Street & Bridge Consolidated Construction Fund as an additional appropriation for Professional Engineering Services Contract with CHIANG, PATEL & YERBY, INC for Design of Reconstruction of Hirsch Rd. from Kelley St. to East Crosstimbers Blvd., GFS N-0617-01-2 (SB9197) and Reconstruction of Parker Rd. from Airline Dr. to Hardy Toll Rd., GFS N-0620-01 (SB9198),

Railroad GFS N-0676-01. Thereby proving that the city can take the road out of the rail, even if Metro can’t take the rail out of the road.
37. ORDINANCE appropriating $400,000.00 out of Street & Bridge Consolidated Construction Fund as an additional appropriation for upgrade and expansion of the City of Houston Monumentation System under Professional Surveying Services Contract with RODS SURVEYING, INC, GFS N-0645-04-2; N-0645-04-3. Monumentation? Is that even a word? And what the heck is a system for it?
38. ORDINANCE appropriating $253,000.00 out of Water & Sewer System Consolidated Construction Fund for a Professional Engineering Services Contract with DMJM H&N, INC for Design of Wastewater Facilities Safety/Security Improvements, GFS R-0302-08-2.
39. ORDINANCE deappropriating $75,000.00 out of Water & Sewer System Consolidated Construction Fund from Professional Engineering Testing Services Contract with QC LABORATORIES, INC; and appropriating $75,000.00 out of Water & Sewer System Consolidated Construction Fund as an additional appropriation for Completion of Water Lines along Almeda Road and Holcombe Boulevard from North MacGregor Way to South Braeswood Boulevard under Professional Engineering Testing Services Contract between the City of Houston and STORK SOUTHWESTERN LABORATORIES, INC. Funding goof, or is this “Peter, meet Paul. Paul, Peter. Now stick’em up?
40. ORDINANCE awarding construction contract to D. L. ELLIOTT ENTERPRISES, INC for Water Distribution System Rehabilitation and Renewal – $1,758,697.49 – Enterprise Fund. Probably a contingency contract for main repair; if there’s something that our maintenance section can’t handle, because it’s a major blowout, we can call these guys in. Or possibly they have several specific projects in mind. Again, I need access to the RCA’s.
41. ORDINANCE appropriating $1,665,000.00 out of Street & Bridge Consolidated Construction Fund, awarding construction contract to KENMOR ELECTRIC COMPANY, LP for Traffic Signal Modification Contract at ten locations along Caroline Corridor and one at Bagby and Capitol-Rusk in the Central Business District (CBD), GFS N-0650-22-3.
42. Sounds like they’re coordinating the rebuild of water/sewer lines and the road, for once.
43. ORDINANCE appropriating $5,506,851.70 out of Street & Bridge Consolidated Construction Fund, and $625,506.00 out of Water & Sewer System Consolidated Construction Fund, awarding contract to TEXAS STERLING CONSTRUCTION, L.P. for Reconstruction of Armour Drive, GFS N-0733-01-3.

50. ORDINANCE appropriating $5,321,700.00 out of Water & Sewer System Consolidated Construction Fund, awarding contract to BOYER, INC for Rehabilitation of Air Release Valves for approximately 47,800 LF of 60â€? WL along Steelman, Bayou, and Dixie from Clinton to Mykawa Road (Package 2), GFS S-0900-A6. LF = “linear feetâ€? and WL = “water lineâ€? of course. Yep, that’s 9 miles of water mains. You know how much the city has overall? Six thousand. It generates a hella lot more revenue than parking tickets.
51. ORDINANCE appropriating $6,906,700.00 out of Water & Sewer System Consolidated Construction Fund, awarding contract to INDUSTRIAL TX CORP. for Treewater and Kirkwood Lift Station Replacement, GFS R-0267-79-3. Gravity flow is important to sewage, but over the size of a city like Houston, at some point, you’ve got to cross under bayous and then lift it back up on the far side.
NON CONSENT AGENDA –
Items 52 & 53: Property
52. RECOMMENDATION from Director Department of Public Works & Engineering, reviewed and approved by the Joint Referral Committee, on request from Ronnie Self, on behalf of himself and Catherine Cash, for abandonment and sale of a portion of Stuart Street, from the U. S. Highway 59 service road to St. Emmanuel Street, located in Fairmont Addition, out of the J. S. Holman Survey, A-323, Parcels SY3-055 and SY3-056 –
A lot of these little pieces are dead ends, chopped off and unconnected to the feeder. They’re not doing anyone any good, and in fact, they’re an eyesore. But couldn’t we sell them instead?
53. RECOMMENDATION from Director Department of Public Works & Engineering, reviewed and approved by the Joint Referral Committee, on request from Jon Welkey, on behalf of the Welkey 1996 Descendents’ Trusts (Greta Joanne Gaskill, Sheryl B. Johnson, and Nancy Jean Lodwig, Co-Trustees), for abandonment and sale of a portion of Tavern Street, from Dow Road west ±271 feet to its dead end, located in Dow Acres Addition, out of the Richard Rowles Survey, A-670, Parcel SY6-089

Hmmmm.
And now the fighting begins over who gets to override the PW&E and Traffic Department’s recommendations to bring the pork home to their districts:
55. WRITTEN Motion by Council Member Wiseman to amend Item 55C below as follows:
Accelerate the funding of design and construction projects related to wastewater capacity improvements in the Kingwood area. Utilize Tax Increment Funds from Reinvestment Zone Number Ten, City of Houston, Texas (Lake Houston Zone), as called for by the TIRZ’s project plan.
a. WRITTEN Motion by Council Member Wiseman to amend Item 55C below as follows:
Restore funding appropriation to CIP No. M-0268 (Gulf Meadows, Kirkwood, South Sagemont), to levels designated in the FY 2006-2010 Capital Improvement Plan.
b. WRITTEN Motion by Council Member Wiseman to amend Item 55C below as follows:
Accelerate the funding of design of Capital Improvement Project No. N-0807 (Northpark Dr. Paving: Lake Houston Parkway to Mills Branch Dr.) to Fiscal Year 2007. Utilize Tax Increments Funds from Reinvestment Zone Number Ten, City of Houston, Texas (Lake Houston Zone), as called for by the TIRZ’s project plan.
c. MOTION by Council Member Khan/Seconded by Council Member Alvarado to adopt recommendation from Director Building Services Department to adopt the CAPITAL IMPROVEMENT PLAN for Fiscal Years 2007 through 2011 and establish a charge for its sale
TAGGED BY COUNCIL MEMBERS SEKULA-GIBBS and WISEMAN. This was Item 2 on Agenda of June 14, 2006 I’m not wise in the ways of the politics on council, so I can’t give this a high degree of veracity, but it looks like Alvarado(D) and Khan(NJR) lined up with the mayor to pass the budget as is, whereas Wiseman wanted more for her district and Sekula-Gibbs backed her. They put off the vote for a week by tagging it. Everyone else kept their heads down last week.
56. MOTION by Council Member Khan/Seconded by Council Member Alvarado to adopt recommendation from Director Department of Public Works & Engineering for approval of FY2007 Operating Budget for the HOUSTON AREA WATER CORPORATION (HAWC) – $20,610,290.00 – Enterprise Fund TAGGED BY COUNCIL MEMBER SEKULA-GIBBS This was Item 3 on Agenda of June 14, 2006 More of the same? Dunno.
57. RECOMMENDATION from City Attorney to deposit the Award of Special Commissioners, into the Registry of the Court, pay all costs of Court and file objections to the award in connection with eminent domain proceeding styled City of Houston v. Grocers Supply Company, Inc., a Texas corporation, et al., Cause No. 855,656, for acquisition of Parcels AY2-173 and AY2-173A; for the COLUMBIA TAP HIKE AND BIKE TRAIL PROJECT; CIP/GFS N-0420-22-2 – $163,998.00 – TAGGED BY COUNCIL MEMBERS LAWRENCE and SEKULA-GIBBS This was Item 11 on Agenda of June 14, 2006
Last week’s eminent domain proceeding. There’s more money that could have funded a cadet class instead of a bike trail.
58. ORDINANCE amending Exhibit “A of City of Houston Ordinance No. 90-1292 (as amended by City of Houston Ordinance No. 2006-165), to amend the Master Classification Ordinance to add, revise and/or delete certain classifications substituting the amended exhibits as part of the current master classification listing. This was Item 17 on Agenda of June 14, 2006 TAGGED BY COUNCIL MEMBERS WISEMAN and ALVARADO. As I said last week, I think this is just an administrative matter, tending to how the ordinances read. I’m not positive of that, though.
59. ORDINANCE approving and authorizing contract between the City of Houston and HOUSTON CLEAN CITY COMMISSION, INC d/b/a KEEP HOUSTON BEAUTIFUL for Volunteer Cleanup Services of City Neighborhood Lots for the Houston Police Department; providing a maximum contract amount – 3 Years – $450,000.00 – General Fund TAGGED BY COUNCIL MEMBERS WISEMAN, HOLM and JOHNSON This was Item 22 on Agenda of June 14, 2006 Well, I guess it counts as a volunteer effort if we’re paying some do-gooder organization with a swank Greenway Plaza address, instead of the people doing the actual clean up. http://www.houstonbeautiful.org/ http://www.mapquest.com/maps/map.adp?formtype=address&country=US&popflag=0&latitude=&longitude=&name=&phone=&level=&addtohistory=&cat=&address=3000+richmond+ave&city=houston&state=tx&zipcode=

b. MOTION by Council Member Khan/Seconded by Council Member Alvarado to adopt recommendation from Director Building Services Department for supplemental allocation of $200,000.00 for contract with HONESTY ENVIRONMENTAL SERVICES, INC for Professional Environmental Consulting Services Contract for the Houston Police Department’s Dangerous Building Program, GFS I-0001-DB-5 – Dangerous Building Consolidated Fund
c. MOTION by Council Member Khan/Seconded by Council Member Alvarado to adopt recommendation from Director Building Services Department for supplemental allocation of $200,000.00 for contract with TECHNOLOGY SERVING PEOPLE, INC for Professional Environmental Consulting Services Contract for the Houston Police Department’s Dangerous Building Program, GFS I-0002-DB-5 – Dangerous Building Consolidated Fund TAGGED BY COUNCIL MEMBER JOHNSON These were Items 26, 26A, 26B and 26C on Agenda of June 14, 2006 . So how many of these buildings are we getting demolished, anyway? It seemed a lot simpler when Ben Reyes just jumped on a bulldozer and smashed them for us. Ok, so he helped himself to some of the nice light fixtures and it was questionable that he had the legal authority to do so, but hey, it was cheaper!
And now we get into the annexations again….
